"A Homer jury last Wednesday awarded Betsy Beeks more than $1.78 million in damages sought from Dr. Rene Alvarez and South Peninsula Hospital for complications she incurred during a laparoscopic surgery performed by Alvarez in 2001.
Beeks reportedly went in for the laparoscopic procedure with Alvarez at the age of 39 for a hernia she developed following extensive injuries from an automobile accident in 1979.
Sitting on a couch that was brought into the courtroom specifically for Beeks because she has difficulty sitting for long periods, the now 48-year-old woman testified last week that she met with Alvarez in his office prior to the surgery, and asked if he was board certified.
“He pointed to the certificates on the wall, so I assumed he was,” Beeks said in court.
According to her complaint, Beeks alleged that Alvarez “failed to recognize and appreciate the likelihood of bowel adhesion in a person who had previous multiple abdominal surgeries and negligently proceeded with the laparoscopic repair.”
The complaint further alleged that Alvarez was “unable to access the peritoneal cavity and perforated the lining of Beeks’ bowels in the attempt.”
Subsequent complications from the surgery allegedly continue to plague Beeks, who sought to regain compensation for past and future wage loss, as well as past and future medical expenses and past and future pain and suffering."
