Anyone who makes the bad decision to ingest some sort of intoxicant and to then get behind the wheel not only faces a high degree of risk, but also creates an unreasonable situation of danger for anyone else on or near the roads at that time. It does not matter who you are - if you engage in this conduct and harm someone else, you could face not only substantial criminal liability, but civil liability as well for injuries and damage caused. This could be the case with an assistant district attorney in Fairbanks who was arrested for his second DUI in seven days after being involved in a crash.
According to the Fairbanks Daily News-Miner:
"A Fairbanks assistant district attorney faces charges of driving under the influence of drugs and felony assault following an accident on the Johansen Expressway on Sunday in which a passenger in one of the vehicles was hurt, though not seriously.
It was the second DUI arrest in seven days for David A. Carlson, 43, who was arraigned Monday in Fairbanks District Court on both DUI charges.
According to criminal complaints filed in court, Carlson was under the influence of prescription drugs both times he was arrested, first on Tuesday when he drove into a ditch on McGrath Road while attempting to drive around an Alaska State Trooper vehicle parked at the scene of an accident, and again on Sunday afternoon when witnesses told Fairbanks police Carlson ran a red light on the Johansen Expressway and collided with a car turning onto the expressway.
A passenger in the car, Akanit Nakoneczny, was transported to Fairbanks Memorial Hospital with minor injuries to her legs.
The driver of the other vehicle, Michael Nakoneczny, told police that after the accident Carlson got out of his pickup, lit a cigarette and began to aimlessly walk around as if he was confused or drunk, according to charging documents."
