  1.   3. Unseaworthiness: The owner of a vessel is liable for injuries caused by unseaworthy conditions on the vessel-without regard to negligence.  Vessel equipment is considered “unseaworthy” if it is not reasonably fit for its intended purpose. The duty to furnish a seaworthy vessel is absolute.  If the vessel is under a bareboat or demise charter, the charterer will be liable for unseaworthiness.

Recoverable damages for unseaworthiness include past and future medical expenses, past lost income, impairment of future income, and past and future pain and suffering and loss of enjoyment of life, interest, and partial attorney’s fees under Alaska law.
