Alaska DUI Accident Serves As Lesson to Act Quickly

E-mail

Alaska DUI accidents happen with regularity, and one of the many reasons that DUI laws provide for stiff penalties is because of the extreme dangers those who drink and drive present for anyone else who may be in the area at the time. One woman who was an Alaska resident at the time nearly paid with her life as a result of an Alaska DUI accident 16 years ago, but thankfully she survived. The other driver was arrested for first-degree assault with a deadly weapon as a result of the incident that took place on the Sterling Highway in Kenai.

Unfortunately, several situations arose that led to an initial dismissal of the charges. By the time another indictment could be issued, the defendant had left the state and could not be found. This situation continued for many years, and the victim of the DUI accident was left to recover from serious injuries that included a fractured femur, shattered elbow joint, fractured thighbone, a fractured first rib, a broken wrist, a fractured finger and wounds from glass being imbedded in her head. She needed more than nine hours of surgery.

Finally, because the defendant was named as a victim of an assault in Georgia, he was located and is now back in Alaska to face his accusers. As of now, the defendant is in jail awaiting a bail hearing, and the victim is married and living in Oregon. No indication has been given regarding the type of penalties the defendant could face despite his blatant culpability in the accident that occurred such a long time ago.

In terms of a potential civil claim for damages brought under an Alaska personal injury lawsuit, questions also remain. The statute of limitations for Alaska personal injury claims is two years, but in certain cases the statute can 'toll' if the defendant takes measures to avoid the legal process or if other exceptions apply. In short, there is no guarantee that this victim could bring an otherwise valid claim for damages against this defendant.
